Charitable Bequests

The easiest way to create a lasting legacy without the risk of outliving your assets is to include a bequest in your will. The bequest can be for a specific amount of money, a specific asset, a percent of the estate or the residuary estate. Benefits of a bequest include:

  • The amount that is given to the Jewish Community Foundation is not included in the estate for estate tax purposes.
  • A bequest is revocable or changeable. You have full use of your assets during your lifetime.
  • Your bequest will be professionally invested and managed by the Jewish Community Foundation of Durham-Chapel Hill to ensure that it lasts and benefits the Jewish Federation or other charitable organization in perpetuity.

Sample Bequest Language

The following sample bequest language is not intended to be legal advice. Please consult an attorney when making or changing your will. Ask your attorney whether a new will is in order or if a simple codicil to your will will suffice.

How to Create a Bequest
To create a bequest in your will, one of the following examples can be used.

  • I give and bequeath to the Jewish Community Foundation of Durham-Chapel Hill, an affiliate of the Jewish Federation of Durham-Chapel Hill, $_____.
  • I give and bequeath to the Jewish Community Foundation of Durham-Chapel Hill, an affiliate of the Jewish Federation of Durham-Chapel Hill, ___% of my residuary estate.
  • I give and bequeath to the Jewish Community Foundation of Durham-Chapel Hill, an affiliate of the Jewish Federation of Durham-Chapel Hill, $____ or ____% of my residuary estate, whichever is larger.

How to Indicate the Purpose for a Bequest

To indicate the purpose for the bequest, one of the following examples can be used.

  • This bequest to the Jewish Community Foundation of Durham-Chapel Hill, an affiliate of the Jewish Federation of Durham-Chapel Hill, shall be used in according with my Legacy Plan, a copy of which resides at its office.

If for a designated organization or organizations:

  • This bequest to the Jewish Community Foundation of Durham-Chapel Hill, an affiliate of the Jewish Federation of Durham-Chapel Hill, shall be used to establish an endowment fund to be known as the ____________________ (your name or names) Fund, the income of which shall be devoted to the support of ____________________ (name of particular charitable organization or organizations). In the unlikely event that such use becomes unnecessary, incapable of fulfillment or inconsistent with the charitable needs of the Foundation, the Fund shall be devoted to the general charitable purposes of the Foundation.

If for a specific, restricted charitable purpose:

  • This bequest shall be used to create an endowment fund to be known as the ___________________(your name or names) Fund, the income of which shall be used for the following charitable purpose _________________ (e.g., services to children or seniors, educational programming about Israel, scholarships for Jewish education or camping). In the unlikely event that such use becomes unnecessary, incapable of fulfillment or inconsistent with the charitable needs of the Foundation, the Fund shall be devoted to the general charitable purposes of the Foundation.
